Os direitos humanos alcançaram maior visibilidade e importância com o fim da Segunda Guerra Mundial, através do consenso internacional de que era necessário estabelecer mecanismos de promoção e protecção destes direitos fundamentais, de modo a evitar retrocessos e arbitrariedades neste domínio.
A nível internacional, a Organização das Nações Unidas (ONU) e o Conselho da Europa (CoE) desenvolveram sistemas de orientação, monitorização e assistência técnica que visam auxiliar os Estados soberanos a garantir o respeito pelas liberdades e direitos fundamentais de todos os cidadãos. A presente investigação procura defender que estes sistemas apresentam imperfeições estruturais que estão, sobretudo, associadas ao comportamento dos Estados.
Num primeiro momento, são analisados os mecanismos de promoção e protecção dos direitos humanos escolhidos para a presente investigação, as suas características e métodos de trabalho. Num segundo momento, recorremos ao exemplo do Estado português para entender o papel destes mecanismos e analisar o contributo nacional para a defesa dos direitos humanos.
Considerando que os mecanismos internacionais de direitos humanos são fundamentais, porém imperfeitos, conclui-se que a concretização efectiva dos direitos humanos requer a cooperação internacional, o entendimento entre os Estados, assim como a participação da sociedade civil.
ABSTRACT: Human rights gained greater visibility and importance with the end of World War II, through the international consensus that mechanisms to promote and protect these fundamental rights had to be established in order to avoid setbacks and arbitrariness in this area. At the international level, the United Nations (UN) and the Council of Europe (CoE) have developed systems of guidance, monitoring and technical assistance aimed at assisting sovereign states to ensure respect for the fundamental freedoms and rights of all citizens. The present investigation tries to defend that these systems present structural imperfections that are, mainly, associated with the behavior of the States. Firstly, the mechanisms for promoting and protecting the human rights chosen for this research, their characteristics and working methods are analyzed. Secondly, we use the example of the Portuguese State to understand the role of these mechanisms and analyze the national contribution to the defense of human rights. Considering that international human rights mechanisms are fundamental but imperfect, it is concluded that the effective realization of human rights requires international cooperation, understanding between States, as well as the participation of civil society.
