O presente trabalho visa demonstrar a transversalidade temporal do asilo, uma vez que este instituto jĆ” conta com vĆ”rios sĆ©culos de HistĆ³ria, designadamente, desde os tempos retratados na BĆblia atĆ© aos dias de hoje, em que vivemos uma das maiores crises de refugiados de todos os tempos. Visa tambĆ©m explicar por que motivo o atual sistema de asilo da UniĆ£o Europeia se encontra obsoleto, dada a necessidade da sua uniformizaĆ§Ć£o.
Apesar de a UniĆ£o Europeia andar indubitavelmente Ć frente no desenvolvimento em matĆ©ria de direitos dos refugiados, tendo criado uma sĆ©rie de mecanismos para uma melhor execuĆ§Ć£o do Sistema Europeu Comum de Asilo ā designadamente, o Gabinete Europeu em MatĆ©ria de Asilo, o Regulamento Dublin, o Eurodac, o Sistema de InformaĆ§Ć£o Schengen, a AgĆŖncia Frontex, a Rede Europeia de MigraƧƵes e a AgĆŖncia dos Direitos Fundamentais (ADF) -, a verdade Ć© que estes sĆ£o aplicados de formas diversas pelos Estados-membros, o que cria um tratamento desigual e dĆspar entre todos os requerentes de asilo.
Por outro lado, a decisĆ£o da UniĆ£o Europeia em legislar sobre esta matĆ©ria atravĆ©s de Diretivas, que nĆ£o vinculam os Estados-membros, ao invĆ©s de o fazer atravĆ©s de Regulamentos, tem contribuĆdo para um tratamento do direito de asilo ainda menos equitativo no seio da Comunidade.
Assim, o presente trabalho defende a uniformizaĆ§Ć£o do sistema de asilo na UniĆ£o Europeia como forma de solucionar os atuais problemas comportados pelo direito de asilo, e bem assim proporcionar uma melhor e mais eficiente aplicaĆ§Ć£o deste instituto pelos Estados-membros. A escolha da problemĆ”tica justifica-se pela atualidade do tema, dada a atual crise de refugiados e a urgente necessidade de lhe fazer face atravĆ©s do melhoramento da polĆtica europeia de asilo.
ABSTRACT: This study aims to demonstrate the temporal asylum crosscutting, given the fact that this institute has already several centuries of history, in particular, since the portrayed times in the Bible to the present day, in where we live one of the largest refugee crises of all times, and simultaneously explain why the current EU asylum system is obsolete, given the need for its standardization. Although the European Union is undoubtedly ahead in developing the rights of refugees and has even created a number of mechanisms for better implementation of the Common European Asylum System ā in particular the European Office on Asylum, the Dublin Regulation, Eurodac, the Schengen Information System, Frontex, the European Migraton Network and the Fundamental Rights Agency (ADF) ā the truth is that these are applied in different ways by Member States, which creates unequal treatment and disparate among all asylum seekers. On the other hand, the decision of the European Union to legislate on this issue trough directives, which are not binding on Member States, rather than through regulations, has contributed to the treatment of asylum for even less equitable in the Community. Thus, this work defends a uniform asylum system in the European Union as a way to solve the current problems that the right of asylum has, to provide better and more efficient application of this institute by the Member States. The choice of the subject matter is justified given the current refugeeās crisis and the urgent need to address it by improving European asylum policy.
